J.D. Byrider Privacy Policy

The following privacy policy describes the types of information collected from you when you use the jdbyrider.com, cnac.com and getcarcredit.com and any other websites, mobile sites, and other online applications and products and services (collectively, the "Sites") provided by J.D. Byrider, Car Now Acceptance Corporation (CNAC), their parent, subsidiaries and/or affiliates ("J.D. Byrider", "we", "us", or "our") . This privacy policy also describes our practices for collecting, using, maintaining, protecting, and disclosing that information.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use the Sites. By accessing or using the Sites, you agree to this policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of this Sites after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

  1. INFORMATION WE COLLECT ABOUT YOU AND HOW WE COLLECT IT

  2. We collect several types of information from and about users of the Sites, including information:

    • by which you may be personally identified, such as name, postal address, e-mail address, telephone number, social security number or any other information the Sites collect that is defined as personal or personally identifiable information under an applicable law ("personal information");
    • that is about you but individually does not identify you, such as your state of residence; and/or
    • about your internet connection, the equipment you use to access the Sites and usage details.
    We collect this informatoin:

    • Directly from you when you provide it to us.
    • Automatically as you navigate through the Sites. Information collected automatically may include usage details, IP addresses, and information collected through cookies and other tracking technologies.
    • Directly from third parties.
    Information You Provides to Us.  The information we collect on or through the Sites may include:

    • Information that you provide by filling in forms on the Sites. For instance, when you use the "Find A Vehicle" or "Locations" functions on the Sites, you will be required to enter your zip code. When you use the "Request an Appointment" function, you will be required to enter additional information, such as your phone number and e-mail address.
    • Information that you provide when you pay us by check or make a payment on https://payments.cnac.com/.
    • Information that you provide when you apply for financing, such as your income information.
    • Your responses to surveys that we might ask you to complete for research purposes.
    • Information that you provide when you use the Chat Now function.
    • Records and copies of your correspondence (including e-mail addresses), if you contact us.
    • Details of transactions you carry out through the Sites, such as your recently viewed vehicles.
    • Information that you provide when access, visit and/or use any third party social networking service(s) that may be integrated with or linked to the Site. See Section 2 below for more information.
    • When you participate in online Promotions (as defined in our Terms of Use).
    • When you subscribe to newsletters, editorial content or promotional content sent via email, mobile app or text message.
    • Your search queries and pages visited on the Site.
    • Credit report information if you choose to get pre-qualified and agree to us accessing your credit report(s).
    Information We Collect Through Automatic Data Collection Technologies. As you navigate through and interact with the Sites, we may use cookies and other automatic data collection technologies to collect certain information about your equipment, geographic location, browsing actions and patterns, including:

      • Log file information – when you use the Sites, our servers automatically record certain log file information, which may include your web request, Internet Protocol ("IP") address, operating system, browser type, referring / exit pages and URLs, geographic location of you and/or your computer, mobile or other device, number of clicks and how you interact with links on the Site, domain names, landing pages, pages viewed, and other such information. We may also collect similar information from emails sent to our users which helps us track which emails are opened and which links are clicked by recipients.
      • Device Identifiers - when you use a mobile device like a tablet or phone to access our Sites, we may access, collect, monitor, store on your device, and/or remotely store one or more "device identifiers." Device identifiers are small data files or similar data structures stored on or associated with your mobile device, which uniquely identify your mobile device.
      • Analytics Information - we use third-party analytics tools such as Google Analytics to help us measure traffic and usage trends for the Sites. These tools collect information sent by your device, including the web pages you visit, add-ons, and other information that assists us in improving the Sites.
      • Cookies and similar technologies - when you visit the Sites, we may use cookies and similar technologies like pixels, web beacons, and local storage to collect information about how you use the Sites. A cookie is a small text file containing information that a website stores on your computer's hard disk so the site can remember something about you at a later time. Cookies can make a website more useful by allowing the site to personalize information for visitors and by storing information about user preferences on a particular Site so that the user does not have to re-enter information, etc., each time he or she returns to the Site. The use of cookies is an industry standard, and many major websites use them to provide useful features to their customers. Most browsers are automatically set up to accept cookies. If you would prefer, you can set your browser to reject cookies. However, you might not be able to use certain features on the Sites. Other third parties may also use tracking technologies to serve you advertisements tailored to interests you have shown by browsing on the Sites and other sites you have visited, and for other lawful business purposes. The use of tracking technologies by third parties is subject to their own privacy policies, not this Privacy Policy, and we have no responsibility or liability in connection with the use of tracking technologies by third parties. Most browsers have options that allow you to choose which cookies may be placed on your device and to delete or disable cookies. Please note though that setting a browser to reject cookies may limit your experience on the Sites.
      • Toll-free telephone numbers - we may use a uniquely generated trackable toll-free telephone number on Sites or in advertisements. If you call one of these uniquely generated toll-free numbers, we (or a service provider acting on our behalf) may collect non-personally identifiable information about the call (e.g. date, time, duration), as well as personally identifiable information (e.g. your name, the number from which your call originated).

    The information we collect helps us to improve the Sites and to deliver a better and more personalized service, including by enabling us to:

    • Estimate our audience size and usage patterns.
    • Store information about your preferences, allowing us to customize the Sites according to your individual interests.
    • Speed up your searches.
    • Recognize you when you return to the Sites.

    Information We Collect Through Third Parties. In order to process some of your requests, including requests for financing, we will seek out information about you from third parties, such as credit bureaus. This information may include assets and payment history, credit history and credit scores.

    We reserve the right to merge or co-mingle anonymous or non-personally identifiable data about you, your offline and online behavior, and/or your computer, mobile or other device (including its geographic location), with your personally identifiable data for any lawful business purpose.

  3. SOCIAL NETWORKING SERVICE INTEGRATION.

If you access, visit and/or use any third party social networking service(s) that may be integrated with or linked to the Sites, we may receive personally identifiable information and other information about you and your computer, mobile or other device that you have made available to those services, including information about your contacts on those services. For example, some social networking services allow you to push content from the Sites to your contacts or to pull information about your contacts so you can connect with them on or through the Sites. Some social networking services will facilitate your access to features made available on the Sites (e.g., if you use your Facebook, Google, or Microsoft Windows Live account to access your CNAC account information). You should make sure you are comfortable with the information your third party social networking services may make available to the Sites by visiting those services' privacy policies and/or modifying your privacy settings directly with those services. We reserve the right to use, transfer, assign, sell, share, and provide access to all personally identifiable information and other information about you and your computer, mobile or other device that we receive through third-party social networking services in the same ways described in this policy as all of your other information.

  5. DO-NOT-TRACK.

  6. We are unable to respond to "do not track" signals or similar tools and settings. We do not provide any information gathered from your activity on our Site to any third parties for online behavioral advertising purposes. We do not allow third parties to collect personally identifiable information about your online activities when you use the Sites.

  7. THIRD-PARTY USE OF COOKIES AND OTHER TRACKING TECHNOLOGIES.

  8. Some content or applications on the Sites may be served by third-parties, including content providers and application providers. These third parties may use cookies, alone or in conjunction with web beacons or other tracking technologies, to collect information about you when you use the Sites. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

  9. HOW WE USE YOUR INFORMATION

  10. We use information that we collect about you or that you provide to us, including any personal information:

    • To present the Sites and its contents to you.
    • For everyday business purposes, such as establishing and managing your user account, processing and collecting payments and providing customer support.
    • To provide you with information, products, or services that you request from us. For instance, J.D. Byrider and its dealers may contact you about your purchase and/or and financing of vehicles at the numbers you provide via call, text, prerecorded message and automatic dialer.
    • To contact you about our products, goods and services that may be of interest to you. If you do not wish to receive future commercial messages from us, simply follow the unsubscribe instructions contained within the message you receive. (But note that you may continue to receive certain communications from us, such as transactional or relationship messages, and/or messages about your account/profile).
    • To communicate about, and administer your participation in, special events, programs, and other offers or Promotions
    • To deliver content (including advertising) correlating to your interests and browsing and usage history, both within the Sites and on other websites and applications;
    • To follow up on any request that you have previously made (e.g., we may contact you to determine whether the dealer responded to your original request).
    • To evaluate and improve our business, including developing new products and services and analyzing the effectiveness of products, services, applications and websites;
    • To diagnose and address technical and service problems;
    • To perform data analyses, including market and consumer research, trend analysis, demographic analysis and financial analysis;
    • To notify you about changes to the Sites.
    • To comply with applicable legal requirements and our policies
    • In any other way we may describe when you provide the information.
    • For any other purpose with your consent.

  11. DISCLOSURE OF YOUR INFORMATION

  12. We may disclose aggregated information about our users, and information that does not identify any individual, without restriction. We will use and share any personally identifiable information about you that you provide us when you obtain a financial product or service from us in accordance with our Financial Privacy Policy Notice , which provides choices in the use and sharing of information.

    Unless otherwise stated in our Financial Privacy Policy Notice, we may disclose personal information that we collect or you provide as described in this policy:

    • To our subsidiaries and affiliates.
    • To fulfill the purpose for which you provide it. If you request information or services through the Site, you agree that we may share personal information with third parties as may be necessary to provide such information to or perform such services for you. For example, if you use the Site's "Locations" form to locate a dealership, we will share the information you entered with that dealership. After information is provided to a third party, the subsequent use or disclosure of such information is subject to those third parties' privacy policies and practices and we do not control their subsequent use or disclosure of information.
    • To contractors, service providers, and other third parties who perform services on our behalf, including, among others, providers of analytical, development, promotional, research, credit card processing, technical and other services. For example, if you make a payment to by credit card, we may share your personal information and credit card information with a third party in order to process credit card transactions, or such information may be collected directly by the credit card processing service provider on our behalf.
    • In the event that you participate in a Promotion on or through the Sites that is sponsored by us and a third party, we reserve the right to share personal information collected in conjunction with the Promotion with the third party. After the information is provided to such third parties, the subsequent use or disclosure of such information is subject to those third parties' privacy policies and practices.
    • If you apply for credit on the Sites with us, our dealers, or any third party, it will be necessary for you to provide personal information to complete the application, including your address, credit information and history, employment and other financial information. We may share your application information with the dealership(s) you selected and our financial partners so that they can process your application and otherwise use it in accordance with their privacy policies.
    • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of J.D. Byrider's or CNAC’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by J.D. Byrider or CNAC about the Sites’ users is among the assets transferred.
    • For any other purpose disclosed by us when you provide the information.
    • With your consent.

    We may also disclose your personal information:

    • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
    • To enforce or apply our Terms and Conditions and other agreements, including for billing and collection purposes.
    • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of J.D. Byrider, CNAC, our customers, or others.

  13. ACCESSING AND CORRECTING YOUR INFORMATION

  14. Access to information that we collect and maintain about you may be available to you. For example, if you created a password-protected account within the Sites, you can access that account to update the information you previously provided. Additionally, if you believe that information we maintain about you is inaccurate, subject to applicable law, you may request that we correct or amend the information by contacting us as indicated in the "Questions or Comments" section below.

  15. YOUR CALIFORNIA PRIVACY RIGHTS

California Civil Code Section § 1798.83 permits users of the Sites that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please send an email to customer service.

  17. CHILDREN UNDER THE AGE OF 18

  18. The Sites is not intended for children under 18 years of age. No one under age 18 may provide any personal information to or on the Sites. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on the Sites, use any of the features of the Sites or provide any information about yourself to us. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 18, please email customer service.

  19. DATA SECURITY

  20. We have adopted reasonable security measures, appropriate to the sensitivity of the personal information, against unauthorized access, disclosure, loss or destruction of personal information. These measures may include reasonable technological, physical and organizational methods of security.

    The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Sites, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

    Unfortunately, the transmission of information via the internet is not completely secure. Although we have adopted reasonable security measures protect your personal information, we cannot guarantee the security of your personal information transmitted to the Sites. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Sites.

  21. TRANSFER OF INFORMATION

Your information may be transferred to, and maintained on, servers and databases located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as your jurisdiction. Please be advised that we may transfer your information to and from any state, province, country or other governmental jurisdiction, and process it in the United States or elsewhere. Your consent to this policy followed by your submission of such information represents your agreement to any such transfer.

  23. CHANGES

  24. We reserve the right to change the terms of this policy at any time. We display an Effective Date at the top of this policy so that it will be easier for you to know when there has been a change. If there are material changes to this policy, we will notify you by posting a notice on the Sites or by other means, such as by sending you an email. We encourage you to review this policy whenever you visit the Sites.
